Right of Cancellation for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity.)

 

Right of Cancellation

You have the right to cancel this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day

• on which you or a third party designated by you, other than the carrier, took possession of the goods, provided that you ordered one or more items as part of a single order and they are delivered together, or
• on which you or a third party designated by you, who is not the carrier, took possession of the last item, provided that you ordered multiple items as part of a single order and they are delivered separately, or
• on which you or a third party designated by you, who is not the carrier, took possession of the last partial shipment or the last item, provided that you have ordered goods that are delivered in multiple partial shipments or pieces, or
• on the date on which you or a third party designated by you, who is not the carrier, took possession of the first item, provided that you have entered into a contract for the regular delivery of goods over a specified period of time.

To exercise your right of withdrawal, you must inform us (Bad Boy Mowers UG (limited liability), Magdalenenweg 24, 31303 Burgdorf, Germany, phone number: +49 (0) 5136 9764474, Email address: info@badboymowers.eu) by means of a clear statement (e.g., a letter sent by mail, email) regarding your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, though this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising the right of withdrawal before the withdrawal period expires.

 

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), without delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. We will use the same payment method you used for the original transaction for this refund, unless expressly agreed otherwise with you; in no event will you be charged any fees for this refund.

We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever comes first.

You must return or hand over the goods to us without delay and in any case no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period expires.

You are responsible for the direct costs of returning the goods. The costs are estimated at a maximum of approximately €350.00.

You are only liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that is not necessary for testing their condition, properties, and functionality.

 

Exclusion of the Right of Withdrawal

Pursuant to Section 312g(2) of the German Civil Code (BGB), the right of withdrawal does not apply to:

Contracts for the delivery of alcoholic beverages whose price was agreed upon at the time the contract was concluded, but which cannot be delivered until at least 30 days after the contract was concluded and whose current value depends on market fluctuations over which the business operator has no influence

Contracts for the delivery of goods or the provision of services, including financial services, whose price depends on fluctuations in the financial market over which the business operator has no influence and which may occur within the withdrawal period, in particular services related to shares, units in open-end investment funds within the meaning of Section 1(4) of the German Capital Investment Code, and other tradable securities, foreign exchange, derivatives, or money market instruments
